MyPetsWelcome law enforcement support

MyPetsWelcome has a dedicated process for law enforcement and government officials to submit lawful requests for user data. We have a team of specialists who review all legal requests and respond promptly in accordance with the law.

The following information is provided for law enforcement and governmental officials who are seeking to request information related to a MyPetsWelcome account with valid legal process.

Legal Process 
As a U.S. company, MyPetsWelcome requires U.S. law enforcement and governmental agencies to follow U.S. law in order for MyPetsWelcome to disclose any user account records.

Our ability to disclose MyPetsWelcome account records is generally governed by the Stored Communications Act, 18 U.S.C. § 2701, et seq. The SCA mandates that we disclose certain account records only in response to specific types of legal process, including subpoenas, court orders, and search warrants.  To obtain private communications or MyPetsWelcome posts, you must serve a search warrant issued by a court of competent jurisdiction (a federal court or a court of general jurisdiction of a state).  You may obtain basic account information about a user pursuant to a valid subpoena.  To obtain other non-content records, such as activity or message logs, a court order that complies with 18 U.S.C. § 2703(d) is required.

Please note that MyPetsWelcome may notify users of requests for their data.  If disclosure would impair your investigation, you must obtain a non-disclosure order that complies with 18 U.S.C. § 2705 to prevent MyPetsWelcome from providing notice.  If you believe that a court order is not required under your state’s law, you should identify that law in your non-disclosure request.

Additionally, please be aware that users may download their own MyPetsWelcome account information using tools MyPetsWelcome makes available to them.  MyPetsWelcome members do not need to provide legal process to download data for their own account.

Data Retention
MyPetsWelcome stores and maintains Member information as described in our Privacy Policy and Terms of Service

Emergency Disclosure Requests
Consistent with 18 U.S.C. §§ 2702(b)(8) and 2702(c)(4), we may voluntarily disclose MyPetsWelcome account records when we believe in good faith that an emergency posing a threat of imminent death or serious bodily injury requires the immediate disclosure of such records.

To expedite review of Emergency Disclosure requests, please provide the following information with your request:

  1. What is the nature of the emergency involving death or serious physical injury? 
  2. Whose death or serious physical injury is threatened?
  3. Why is this situation an emergency such that normal disclosure processes would be insufficient or not timely?  Is there reason to believe the threat is imminent?  Please provide information that suggests that there is a specific deadline before which it is necessary to receive the requested information (e.g., the threatened act will take place tomorrow before 5 pm).
  4. What specific information do you believe is in our possession related to the emergency?  Please make your request as narrow as possible; requesting all information about an account will delay the processing of your request.  
  5. Please explain how the information you are requesting will assist in averting the threatened emergency.

Preservation Requests
We honor formal requests from law enforcement to preserve information in accordance with 18 U.S.C. § 2703(f). Upon receiving a signed and dated preservation request on law enforcement department letterhead, we will attempt to preserve available MyPetsWelcome account records associated with any properly identified account for up to 90 days, and will extend the preservation for one additional 90-day period upon an appropriate request.

To submit a request for Member information to MyPetsWelcome, law enforcement officials or government agencies conducting criminal investigations should submit their request through the Law Enforcement Online Request System . This form is the central place for law enforcement to securely submit requests to our specialists.  This system may not be used by private parties or governmental entities in civil actions.  MyPetsWelcome will not process requests from these parties submitted through the Law Enforcement Online Request System.

MyPetsWelcome identifies users by their email address and username. Please include an email address, full name, or home address in any request for user information and include the neighborhood name, if known.  MyPetsWelcome has limited ability to search by given name, and often cannot locate a unique account with responsive information unless provided with an email address or username. 

Please note that acceptance of legal process by these means is for convenience and does not waive any objections, including, but not limited to, lack of jurisdiction or proper service.
